Joe Biden’s insanity defense

Is he faking it?

Yesterday, the special prosecutor (technically called a “special counsel” these days, a term which obfuscates in my opinion) released his report on his investigation of Joe Biden’s mishandling of classified documents.

(It was not a good day for the Democrats. On the same day, the Supreme Court signaled in oral argument that they intend to smack down four publicity-hungry Colorado Supreme Court justices/activists who canceled Donald Trump from the Colorado ballot. My condolences to those four partisan hacks whose 15 minutes of fame is about to expire. And my congratulations to the three spirited dissenters on that same court, who’ve been vindicated.)

The special prosecutor’s investigation concerned Biden’s removal of highly classified materials from government offices including the White House. He put the materials into his garage, his basement, his beach house, his Corvette . . . you know, all the places you keep the nation’s top secrets.

He did this numerous times.

The special counsel found that it’s even worse than that. Biden also disclosed some of the classified materials to people without security clearance, including the person who ghost-wrote a book published under Biden’s name.

The special prosecutor found that Biden’s multiple violations were “willful.”

But the special prosecutor decided not to bring charges. His rationale was that Biden “was likely to present himself [to a jury] as an elderly man with a poor memory.” As evidence of that, the special prosecutor noted that in interviews of Biden:

·     He appeared to possess “diminished faculties with advancing age”,

·     He “did not remember when he was Vice President”, and

·     He “did not remember, even within several years, when his son Beau died.”

As for the last point, the special prosecutor could have added “or on what continent.” Biden has mentioned many times that his son died as a soldier in the war in Iraq. In truth, he died of cancer in America, years after the Iraq war and long after his discharge.

OK, it’s obvious that Biden is not aging well and, for that, he probably deserves some sympathy.

But being “an elderly man with a poor memory” is not a defense to a criminal prosecution, including criminal prosecutions for violation of the nation’s laws governing classified materials. So, the real defense is that Biden’s elderliness and poor memory add up to something more – something that is indeed a defense to most crimes.

Insanity.

Pause here. Biden’s criminal acts in breaching the nation’s laws protecting classified materials occurred back when he was Vice President – in the 2009-2016 time frame about a decade ago.

Anyone who thinks Joe Biden is more cognitive now than he was ten years ago, raise your hand, chief. I’ll pay for your one-way ticket to join Joe and Jack in the cuckoo’s nest.

On the other hand, it is possible, I suppose, that Joe is not really as far gone as the special prosecutor reports him to be. It could be an act. If it surprises you that criminal defendants sometimes act insane in order to beat the charges against them, then please raise your hand for that free ticket.

On the other, other hand, it’s revealing that the White House declined an invitation for Biden to be fluff-interviewed by a friendly face in the pregame to the Superbowl, something that the networks have done for years with sitting presidents. Such an interview would be a golden opportunity to show a few hundred million people that he’s a good guy.

Why did the White House decline that invitation, especially in an election year when candidates normally crave attention, especially the free kind and especially the friendly kind?

The only answer I can conceive of, is that Biden’s handlers are afraid he’ll present not as a good guy, but as a person so lacking in cognition that he truly is insane. Or at least unelectable. He’ll present to the American people as he presented to the special prosecutor.

The White House succeeded in refusing to make Biden available for that friendly Superbowl interview – something I suspect Biden wanted dearly to do – but they were unable to stop him from giving an impromptu and angry press conference right after the special prosecutor’s report was released.

In that press conference, Biden attacked the special prosecutor for disclosing to the American people his real – or fake – mental limitations. He shrieked that his memory “is fine” and then went on to mention that the Mexican president is the head of Egypt.

Even the friendly poodle press described his performance as “a disaster.”

So. We have a president who either (1) has defrauded a prosecutor into waiving charges for breaching the nation’s laws on classified government documents by pretending that he is insane (which would constitute the additional crime of obstruction of justice), or (2) is indeed criminally and combatively insane and whose handlers are now defrauding the American people by pretending that he’s not so that he and they can enjoy another four years in the White House at the expense of the country and the world.   

Now remind me. Who’s the “threat to democracy”?
